This User Agreement (the "Agreement") is a contract between you ("User") and Magic Book LLC, a Texas registered Limited Liability Company ("Magic Book," "we," "us," "our"), and governs your access to and use of the Magic Book application (the "App").
By accessing or using our App, you agree to comply with and be bound by this Agreement. Please read this Agreement carefully before using the App.
When you use Magic Book to generate stories ("Generated Stories"), both you and Magic Book LLC will hold commercial usage rights to the Generated Stories. This means that both you and Magic Book LLC can use the Generated Stories for commercial purposes, such as publishing, selling, or licensing the Generated Stories.
You agree that Magic Book LLC may use, modify, adapt, publish, distribute, publicly perform and display the Generated Stories for any purpose and in any media formats and channels, without any compensation to you.
The Generated Stories are 100% fictitious. Any resemblance to actual persons, living or dead, or actual events is purely coincidental. Magic Book LLC does not endorse or assume responsibility for any Generated Story.
You understand and agree that Magic Book LLC will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from the use of or inability to use the App or any Generated Stories.
You agree to indemnify and hold harmless Magic Book LLC, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the App, including but not limited to your violation of this Agreement.
You agree not to use the App for any illegal, harmful, misleading, or discriminatory activity. You are responsible for all activity under your account.
By using the App, you confirm that you are at least 13 years old. If you are between 13 and 18 years old, you confirm that you have parental consent to use the App.
Magic Book LLC reserves the right to suspend or terminate your access to the App at any time for any reason, including violation of this Agreement.
Your use of the App is subject to our Privacy Policy, located here.
Should any provision of this Agreement be deemed unenforceable or invalid, such provision will be curtailed or removed to the minimum extent required. This measure is taken to ensure the remainder of the Agreement continues to be enforceable and maintains its full force and effect.
Our failure to enforce any part of this Agreement shall not constitute a waiver of our right to later enforce that or any other part of this Agreement. Waiver of compliance in any particular instance does not mean that we will waive compliance in the future.
By using the App, you represent that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, please do not use the App.
We reserve the right, at our sole discretion, to amend or revise this Agreement at any time. Any changes will be effective immediately upon posting to the App, and your continued use of the App following the posting of changes will constitute your acceptance of such changes.
